State law has placed a moratorium on the establishment of new nursing facilities and on the increase to licensed capacity of existing nursing facility licenses, with some statutory exceptions.

Change in owner, operator, or lessee of a licensed Nursing Facility requires prior review by the Health Services Council and approval by the licensing agency. Completion and submission of the Change in Effective Control application is a prerequisite to any change. The Change in Effective Control application shall be submitted to the Center for Health Systems Policy Regulation. more
