Asbestos Real Estate Disclosure

When buying or selling a home, consumers frequently have questions regarding building materials that may contain asbestos. While the RI Asbestos Act does not prohibit the sale of a property that contains asbestos, it is recommended that home buyers determine if asbestos containing building materials are present

Title 5 Chapter 20.8 of the Rhose Island General Laws requires disclosure of owner’s knowledge of deficient conditions, including hazardous materials as asbestos in certain real estate transactions. You should discuss this requirement with your real estate agent, or contact the Rhose Island Department of Business Regulation at 401-222- 2255.

If you purchase a home that contains asbestos building materials that are damaged, or that you plan on removing, please visit our Homeowner Information page for guidance. Asbestos containing building materials may be considered damaged if they are worn, peeling, cracking, crumbling or in otherwise deteriorated condition. Friable asbestos containing building material (material that when dry can be crumbled, pulverized or reduced to powder by hand pressure) is of greater exposure risk than non-friable material.
